Thursday Notes

It is late on Wednesday night and I am coming to you live from the casa de Turkey Hunter and Hubby in Lexington, where I am attending the New Lawyers Conference at the Convention Center. Attending this conference is a bit strange, since I have now been a lawyer for almost five years, but that is the way things go when you move states and change jurisdictions. The room is full of the next generation of young lawyers in Kentucky, all of whom are attempting to stay focused, making fun of the guy who keeps answering all the questions and playing gunner at a convention and watching the endless clips of “A Time to Kill” played in every session. IF you arent a lawyer, then you likely dont have to go to CLE events (where you get “legal education” after becoming an attorney) and thus dont get to see the ubiquitous nature of “Time to Kill” clips at all CLE events (as first noted by the Turkey Hunter). Whenever a speaker makes his or her program, they always try to “spice it up” by adding clips from movies….and the two go-to favorites are “My Cousin Vinny” and “A Time to Kill.” Both have already been shown at the events here at this conference and all new attorneys laughed with glee as they once again saw poor Joe Pesci found in contempt in the state of Alabama. “A Time to Kill” is really not that great of a movie….lots of good components, Spacey, Samuel L, Ashley, even Matty Ice….but the fact that it is used to showcase key components of what it means to be a lawyer by bar associations all over the country (or at least in the ones I am a member of in Kentucky and Virginia) is a little bit frightening. But hey, I guess it could be worse…..I could have been forced to watch a clip from “The Practice”….no wait, that happened too.

Ok, enough about that. The only news worth reporting this evening is that the KHSAA has denied the transfer of Chad Jackson as well to Scott County, saying that the prior ruling was actually a “clerical error.” By that, they mean that whereas the paper was supposed to say he “CANNOT TRANSFER”, it instead said he “CAN TRANSFER.” You can see how that would happen. Once again the ruling highlights the increased absurdity of institutions like the KHSAA, as they attempt to stop something that simply cant be stopped in a free country….the movement of people from location to location. The KHSAA cares (understandably) about things like “competition” and “balance”, but like the NCAA, forgets that there are things more important than making sure the regions across the state have similar basketball strengths. Kids should have the ability to attend the school of their choice….ESPECIALLY if their family makes the decision to move in the process. In the same way that a family may choose to move because of a better science program, a better music department or a better neighborhood school, a family should also be able to move because they like the basketball better at another place. Dakotah Euton and Chad Jackson and their families are making a life choice to go to high school and get a free public education in a different place than where they were before….and the KHSAA, designed ostensibly to help these students, has no right to have a trump card on telling these young men where they can go to school and play basketball. You may not like Coach Hicks at Scott County and you may think some of his methods to attract players are unscrupulous….that is fine. But at the end of the day, this isnt about Hicks, its about Euton and Jackson and the rights of kids to go to school where they want, without organizations that are old and out of touch making that decision for them. Yes, Scott County’s basketball team will be better….and yes, it is unfortunate that basketball “recruiting” is becoming a bigger part of the sport on the high school level. However if we think its ok for families to make decisions on living situations based on academics or music or other factors….then basketball can be one too. And for the KHSAA to say otherwise is patronizing and hypocritical.

And with that, I am off to bed…..tomorrow is another 8 hours of CLE at a convention hall filled with free Mountain Dew. Good night!

    Are you telling me that there are lawyers in Kentucky that go by the names of Turkey Hunter and Hubby?
    A Time to Kill is a good movie but as always a better book. The movie gets extra credit in my mind because Ashley spends every scene that she is in dripping in sweat. I get excited just thinking about it.

    Matt–Kudos. I would not expect that view coming from you. Most liberals are for more government and rules instead of less. Give it a few years and you may grow up and be a man and switch over. That was the reply by Reagan when asked why he switched from being a Dem to a Rep. It was something to the effect, “When your a boy, you do boyish things and when then you become a man.” Give it time.

    You will be out of commission tomorrow so that means there will be some “big” story come out. That is usually what happens when you are tied up. What will it be? Hopefully nothing too bad. Hell, for that MATTer, it could be that Orton, Wall and Stephenson all give a verbal to the CATS. A guy can hope, right?

    The KHSAA is a joke and it should be more about the kids and not about Billy Hicks. BUT what about the other kids in Scott County’s district and region that would have to play the equivelent of a good college team just because some kids’ (who happen to be very good at basketball) parents all the sudden get jobs at Toyota (it should be said that I ahve no idea where their parents are working but that has been the MO in the past).

    KHSAA…..*sigh*
    I went through this with my brother last year.
    We moved from Rowan to Carter and he only got
    to play in 4 games while the KHSAA goofed around
    making decisions.

    There needs to be some oversight here.
    No organization should be that autonomous.
    Except for the Supreme Court, maybe.

    3- It is my understanding that the more education you have, the more likely you are to vote dem. That is unless you are a Neo-Con, Evangelical, or are in the richest 1%. I am not dogging those folks, I am just saying they are the most likely to be educated, and not just look at the T.V. and say things like “I’m go vote for McCain, cause I wanna keep my gun !”, like the NASCAR Republicans do. I like the morals that the Republicans say they have, I just really dont think that matters anymore. I also think you are mistaken on the fact that liberals are on the side of government more than the common man, hence the term “bleeding heart liberal”.

    gocats, amen brother. i’ve been preaching the “more of me” message for awhile and its fallen on deaf ears. this type of info might be exactly what the movement needs.

    and screw the khsaa. i dont really have an opinion on this but they suspended me for a game my senior year. i still hold a grudge.

    The education system in KY is a joke.

    We give Dr. Todd a $50,000 bonus and yet UK has a hiring freeze at the same time? The state budget is very tight at the moment so he shouldn’t get such a bonus this year.

    10- Good point, but if you listen to most old folks they are gonna go with the Reps., most preachers are gonna do the same, at least around these parts, and it seeems that most economist are gonna be libretarians. Maybe I shouldnt say most, but you see my point I hope and if you have a professor that is any of the above thaen they will likely lean towards the right, but most of the other educated folks may lean to the left. I’m not saying they are all dem. they are just more enlightend and vot that way.

    Matt, I agree with you on the KHSAA tip. I coach baseball in Louisville, and although the playing field is pretty level in that sport, all they want to do is water down the football playoffs so everybody gets a trophy. They’re constant vigilance on trying to make things “fair” for everybody only adds to what’s wrong with America today: a lack of competition that leads to apathy and laziness.

    I don’t get this KHSAA ruling at all. I transferred schools my senior yr to play for a better team, and all I had to do was provide evidence of a residence in that county. If his parents (or aunt or uncle) have a house in Scott Co. why can’t he play ball there? Did they change rules since the 90’s?

    12) it was a $150,000 bonus not 50,000. He gave 50,000 of it back and kept the rest. It would have been great PR to just give the entire bonus back to the Univ. since this yr they are forced to cut 180+ jobs, freeze all raises for faculty, and slap a 9% tuition increase on the students.

    All in the pursuit of being a Top 20 Univ., I guess.

    12.) We gave Lee a $135,000 bonus, he accepted $95,000, and donated the other $40,000 back to the University (which he can write off). It is all rediculous, I know many good people that work at the University, a few of which I had as professors and without them Lee Todd wouldn’t be ish, and he gets the bonus, while everyone else who makes Todd look good gets pay freezes. WOW!!! To tie that in with a common theme on this blog it is the classic example of a conservative run government. Very beaurocratic, ran by the elite, for the elite, to benefit the elite (lets tax middle america so they can not afford to spend any money to enhance the economy …….. GENIOUS!!!!!)

    13, I think you’re in over your head on this discussion, stick to jump shots and defense. Matt’s argument is actually pretty conservative and like #3 I was surprised when I read it. School choice is definitely not a liberal/Democrat idea because the Teacher’s unions hate school choice. The KHSAA is run by educators, thus thye don’t care that they are, in a way, stepping on school choice.

    18 - if Todd took the full bonus and donated $50,000 back to the school as a write off…then Todd needs a new accountant. Donations are not $ for $ credits for tax purposes, so it was pretty dumb if that is what he did. Also, are you going to complain about BCG’s pay too?

    I also agree with Matt. There are people that transfer schools all the time because one school has “better teachers,” “better programs” or a “soccer team”. I’ve seen this happen tons of times (my wife is a teacher). If you are allowed to transfer schools to get your child the best education for their future, then you should be allowed to give your child the best sports program available (also the best for their future.) Some of these kids will actually earn a living playing basketball and I think it is criminal for the KHSAA to interfere with these kids future.

    22.) I said he donated $40,000 back to the University that he CAN (and will) write off. So lets think about it, he gave 40,000 back to the people who write his paycheck, and he gets the 40,000(or a good portion) back at the end of the year. BCG and President Todd’s pay are two totally different issues. That being said, if the University is in such a great “recession,” then yes BCG’s pay should be cut or frozen just as everyone else’s. There are way more lives and futures in the hands of the teachers and administrators than in BCG’s, and if you cant see that then you need to take them blue shades off for one second, and look at the big picture!!!!

    I do not know much about the Jackson situation. But the Euton situation has GOT to be reviewed. I think the basis behind this is keeping extra curricular extra curricular. It is considered a privilege to have extra curricular activities at the high school level. I actually agree with this. Games should be won on the court and not at recruitment at this level. How the KHSAA goes about it is the joke. Singling out a school or a player based on a projected status is nothing short of discrimination. Anyone know a lawyer?

    When I was in high school I was denied transferring to Hickory High because I slipped up and told a reporter I thought four passes before shooting was a bit excessive.

    I thought this post was about tranfers not politics? Anyway… as far as I am concerned Euton should be eligible if his family had to relocate because his father’s place of employment shut down. This fact should show the KHSAA that the move was not based solely on athletic reasons. I believe that he will get a waiver on an appeal. But Jackson’s situation is different. His family decided to “relocate” after they learned of the Euton’s possible move. It seems their reason for relocating was purely basketball reasons. I wish him the best, but that will make it very difficult to obtain a waiver to play ball next year. The true mistake was likely not ruling Euton eligible and Jackson ineligible.

    27 - I was just stating that you jumped on Todd about taking a bonus and pay, but did not mention other highly paid UK officials, and felt like you should have. People are jumping all over Todd’s pay raise and how it relates to the “pay freeze” but no one has brought up the other “highly compensated” employees of UK (e.g. BCG).

    Just for the record, try not to be so defensive with your posts. My “blue shades” had nothing to do with my post.

    36.) You misunderstood, it is not Todd’s fault he got the raise, the problem is that he got a raise while we have to cut jobs and freeze pay on others. It is the classic example of elitism in its own little buearocracy, the rich get richer, while the poor get poorer or stay the same. It makes absolutely no sense!!!! What I was saying is that I do think that it was a little frugle of a man that makes so much money to donate less than 30% to the University and people that make him eligible for a raise…… He needed that 135,000 like he needed a hole in his head!

    Call me an uneducated, mostly Republican view type of individual but I don’t understand the argument about Todd. I am out of the loop since I live in AZ (that explains why I was up at 1 am KY time and late to the dance this morning) but it was a BONUS, right? A hiring and pay increase freeze would have nothing to do with a BONUS system that is aleady included in the contract. If he hit the thresholds and deserves the BONUS, you can’t take it away or it is liable to cost about 1.5 million or more in lawsuits. Sad that it takes an uneducated low life to point out the obvious. I guess that is the difference between the two Parties– one bases their decisions on the obvious while other is more off of emotions.

    I know our fearless leader is not backing up my argument too much but I explain it like this: I am not a George W. fan with some of the decisions that he has made (too many to mention) but he is certainly better than the alternative. I shutter to think the how things would have turned out if Kerry or Gore would have been and that seat. Especially Gore with the 9/11 events.
